    If the holder of a Chinese visa has expired but is still in China or is working in China without a work permit to earn money, it is considered a Chinese visa violation. The Chinese National Immigration Administration imposes different sanctions and penalties on individuals when they detect a Chinese visa violation.

    What is the Penalty for Violating a Visa in the People's Republic of China?

    Foreign nationals who violate Chinese visas may be subject to fines, imprisonment, and even a ban on entering China.

    It is very important to pay attention to how many times your Chinese visa allows you to enter and to exit the country before your visa expires after you arrive in China, so that you do not violate your visa.

    The Penalty for Living Illegal in China

    Living illegally in China without extending your visa and exceeding your stay will result in fines and other sanctions.

    If you overstay your visa or residence permit by a short period, you will be warned and fined. The fine is usually 500 CNY per day, not to exceed 10,000 CNY in total.

    If you overstay your Chinese visa by a significant amount of time, for example more than 1 month, you may be detained in a detention facility for 5 to 15 days and sent back to your country. You may be blacklisted from re-entering China for 10 years, and your visa applications for other countries may also be affected.

    If you intend to stay in China for longer than allowed, you must apply for a Chinese visa extension by contacting the relevant authorities.

    What to Do If Your Chinese Visa Exceeds Its Duration

    If you have overstayed your visa in China, you must report your situation to the local police station as soon as possible and pay the set penalty.

    If you overstay your visa, you will need to apply for a zero-entry Chinese visa, also known as an exit permit, to leave China .

    Punishment for Illegal Work in the People's Republic of China

    If you work illegally in China, you may be subject to fines and imprisonment.

    Once you are found to be working illegally in the country, you will be deported from China after being fined or imprisoned. Entering the country and earning money by working without a Chinese work visa is considered illegal work.

    Foreigners working illegally in China without valid work documents may also be subject to fines of between 5,000 and 20,000 Chinese yuan and, in serious cases, detention of between 5 and 15 days.

    Can People Who Violated Their Chinese Visa Get a New Visa?

    If you have violated your Chinese visa, you can re-apply for a Chinese visa.

    In your new application for a Chinese visa, you must provide a valid reason for your previous violation and provide information about the sanctions imposed by the Chinese National Immigration Administration ; otherwise, your Chinese visa application will be rejected.
